Short-term rental rules in Hungary: what investors need to know in 2026

In Hungary, letting an apartment to holiday guests is a regulated accommodation service rather than a simple tenancy. This guide sets out the main obligations as they stand under the rules in force in October 2026.

Short-term rental rules in Hungary rest on four requirements: the property must fit a legal accommodation category, the operation must be notified to the local municipal notary (jegyző), the property must be registered with the National Tourism Data Service Centre (NTAK), and it must hold a valid quality classification. Collecting tourist tax and recording guest data complete the picture.

This article is general information, not legal or tax advice. Hungarian rules in this area have changed several times in recent years, so please confirm the position with a Hungarian lawyer and tax adviser before making a decision.

Which laws set the short-term rental rules in Hungary?

The core framework is Act CLXIV of 2005 on Trade and Government Decree 239/2009 (X. 20.) on accommodation services. The Act states that accommodation services may only be provided in compliance with the classification rules and after notifying the commercial authority.

Data reporting is governed by Act CLVI of 2016 on tourism development areas and its implementing Decree 235/2019 (X. 15.). Classification is set out in Government Decree 40/2025 (III. 11.), and the tourist tax framework comes from Act C of 1990 on local taxes.

Private accommodation or ‘other accommodation’?

A short-term let apartment normally falls into one of two categories, depending mainly on who provides the service. The definitions in the Trade Act differ as follows.

CriterionPrivate accommodation (magánszálláshely)Other accommodation (egyéb szálláshely)
Operated bya private individual or sole traderanyone other than a private individual or sole trader, e.g. a company
Type of propertya flat, holiday home or habitable building (or a defined part of one)a self-contained unit within a building
Maximum rooms825
Maximum beds16100

Under Decree 239/2009, only one type of accommodation operation may be carried on at a given property. If a company buys the apartment, or if someone other than the owner provides the service, the category may differ from that of an individual letting in their own name. It is worth settling this together with the purchase structure.

How do you register a rental property?

The operation must be notified to the notary of the municipality where the property is located, who acts as the commercial authority. The notary then enters the property in the local accommodation register, and the service may start following the notification.

Under section 6 of Decree 239/2009, the notification must include or be accompanied by, among other things:

  • the operator’s name, address and NTAK registration number;
  • the property’s address and site plan (the notary retrieves the land registry number directly);
  • the legal basis for using the property and, where the property is not the applicant’s own, a document proving it;
  • a document confirming that property management software is in place.

Changes must be reported to the notary and updated in NTAK, and closure must be notified to the notary within eight days. Operating outside the rules can lead to fines.

What is NTAK and what must be reported?

NTAK is the national tourism data system, and accommodation may only operate if it is registered there and uses property management software. It is run by Visit Hungary, the national tourism organisation.

Under Decree 235/2019, the software transmits statistical data automatically: daily data within 24 hours of the day concerned, monthly data on the 5th of the following month, and event-driven data once guest details are recorded. These statistical feeds contain no guest personal data.

Separately, guests’ identity details must be recorded in the software. Under section 9/H of Act CLVI of 2016 they are sent in encrypted form to a government-designated hosting service (commonly called VIZA) and kept until the last day of the year after recording.

Is a quality classification mandatory?

Yes. In 2026 a valid classification is a condition of providing accommodation services, including private and other accommodation. Classification is carried out by the Hungarian Tourism Quality Certification Board (MTMT) on the operator’s application through its online system.

The classifying body may also open a review on its own initiative during the validity period. Standards therefore have to be maintained continuously, not only at handover.

How does tourist tax work in Hungary?

Tourist tax is paid by the guest but collected by the accommodation provider, who pays it over to the municipality monthly, by the statutory deadline. Each municipality introduces the tax by local decree and sets its own rate.

The Act on local taxes allows either a fixed amount per person per night (the statutory cap of HUF 300 can be indexed to inflation, so the cap actually applicable is higher) or up to 4% of the room rate. Guests under 18 are among those exempt.

We could not confirm the current Nemesbük rate from an official source for this article, so please check it directly with the municipality before buying. As the tax is borne by guests, it mainly matters for pricing and for the total shown on booking platforms.

Can local councils restrict short-term lets?

Yes. Under section 6/D of the Trade Act, a municipal council (in Budapest, the district council) may set by decree the maximum number of days per calendar year that private or other accommodation may be used for guests. Where no such decree exists, there is no time limit.

So far, restrictions have mainly appeared in Budapest. According to a 2026 information booklet from the Budavár district, no new private or other accommodation can be registered in Budapest until 31 December 2026, and districts may also set an annual day limit by decree. We found no such decree for Nemesbük, but this is worth confirming with the local notary.

What can a professional operator take on?

A full-service operator handles most day-to-day compliance, but the split of legal responsibility should be set out clearly in the management agreement. At HillGate, PrideAndProperty Építő Kft. stays on site as operator after handover and provides full-service letting: revenue management, sales through the direct channel, Booking.com and other OTAs (online travel agencies), guest relations, keyless check-in, housekeeping, maintenance and a monthly itemised owner statement.

Our article on full-service short-term rental management explains the operating model in more detail. Before signing, it is worth clarifying each of the following:

  1. Who will be the registered operator with the notary and in NTAK?
  2. Who applies for and maintains the classification, and who bears the cost?
  3. Who collects and pays tourist tax, and how does it appear in the owner statement?
  4. How are guest data recording and software reporting handled?
  5. Who reports changes, for example on a change of ownership?

The income model shows three illustrative scenarios; it is not a promise of returns. For background on demand, see our article on Hévíz tourism statistics.

Frequently asked questions

Do I need a licence to rent out an apartment short term in Hungary?

No separate licence is required, but the operation must be notified to the local municipal notary, and the property needs NTAK registration, property management software and a valid classification. The service can start following the notification.

What is the difference between private and other accommodation?

Private accommodation is run by an individual or sole trader, with up to 8 rooms and 16 beds. Other accommodation is run by someone else, such as a company, with up to 25 rooms and 100 beds.

Is classification compulsory for a holiday apartment?

Yes, under the rules in force in October 2026 a valid classification is a condition of operating. It is issued by the Hungarian Tourism Quality Certification Board in 1 to 5 star categories and is valid for three years.

Who pays tourist tax in Hungary?

The guest bears the tax, but the accommodation provider collects it and pays it to the municipality monthly. Each municipality sets its own rate, and guests under 18 are exempt.

Can Nemesbük restrict short-term lets?

Hungarian law allows every municipality to set an annual day limit. We found no such decree for Nemesbük, but buyers should confirm this with the local notary before purchase.
